Terms of Service

These Terms of Service ("Terms") govern your access to and use of the wireless services, website, mobile application, and related services (collectively, "Services") provided by Aura Wireless ("Aura," "we," "us," or "our").

By activating a SIM, creating an account, or using our Services, you agree to these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old and a legal resident of the United States to use our Services. By agreeing to these Terms, you represent that you meet these requirements. If you are using the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

To use our Services, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Promptly notifying us of any unauthorized use of your account
• Keeping your contact and billing information current

We reserve the right to verify your identity as required by telecommunications regulations. Providing false information is grounds for immediate account termination.

3. Services and Plans

Plan Description

Aura offers wireless service plans including Park, Roam, and Prime. Plan details, pricing, and features are described on our Plans page and may be updated from time to time. The Services operate on a network of partner carriers and are subject to their network availability and terms.

e-SIM and SIM Provisioning

Our Services use e-SIM technology and, where applicable, physical SIM cards. e-SIM activation requires a compatible device. You are responsible for ensuring your device is compatible before subscribing. SIM provisioning is subject to identity verification requirements imposed by our carrier partners and applicable telecommunications regulations.

Coverage and Network Quality

We provide wireless service through a network of partner carriers across 185+ countries. Coverage availability and quality vary by location and may be affected by factors outside our control, including terrain, weather, network congestion, and partner carrier limitations. We do not guarantee coverage, speed, or continuous availability in any specific location.

Roaming

International roaming is subject to availability and may incur additional charges depending on your plan. Rates and coverage for international use are disclosed in your plan details. Roaming availability in specific countries may change without notice based on carrier partner agreements.

4. Billing and Payment

Subscription Fees

Subscription fees for monthly plans are billed in advance on your billing cycle date. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Usage-Based Charges

For plans with metered or credit-based billing, charges are computed based on actual data usage as reported by our network systems. Usage records are the authoritative measure of consumption. If you believe a usage record is incorrect, contact us within 60 days of the charge to dispute it.

Credits

Monthly credits included in Park and Prime plans reset on your billing date and do not roll over unless otherwise specified. Credits have no cash value and cannot be transferred.

Payment Methods

We accept major credit and debit cards. You represent that you are authorized to use any payment method you provide. We are not responsible for fees charged by your bank or card issuer in connection with transactions.

Failed Payments

If a payment fails, we will attempt to collect it up to three times. If payment cannot be collected, your service may be suspended until the outstanding balance is resolved. We may charge a reactivation fee for suspended accounts.

Taxes and Fees

Your total charges include applicable federal, state, and local taxes, regulatory fees, and surcharges. These fees are not Aura charges — they are required by law and passed through to you at cost.

5. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to your service until that date. We do not offer prorated refunds for partial months.

Refunds

We offer a 30-day satisfaction guarantee for new subscribers. If you are not satisfied within 30 days of your first activation, contact us for a full refund of your first month's subscription fee. Data usage charges beyond any included credits are non-refundable. After 30 days, subscription fees are non-refundable.

SIM Deactivation

Upon cancellation or termination, your SIM or e-SIM profile will be deactivated within 24 hours of your service end date. Your phone number may be reclaimed after a 90-day hold period.

6. Acceptable Use

You agree not to use our Services to:

• Violate any applicable federal, state, or local law or regulation
• Transmit spam, unsolicited commercial messages, or automated calling campaigns (including robocalls) prohibited by the TCPA
• Engage in fraudulent activity, including SIM swap fraud, account takeover schemes, or telecommunications fraud
• Resell or commercially redistribute wireless service without our written authorization
• Use SIM cards or e-SIM profiles in ways inconsistent with their assigned purpose (e.g., using a consumer SIM for commercial IoT deployments without an appropriate plan)
• Attempt to circumvent or reverse-engineer our network management or routing systems
• Interfere with our network infrastructure or the networks of our carrier partners
• Transmit material that infringes intellectual property rights, is defamatory, or is otherwise unlawful

Violation of this section may result in immediate account suspension or termination without refund and, where applicable, referral to law enforcement.

7. Network Management

Aura uses automated network management, including AI-driven routing, to maintain service quality for all users. We may manage network traffic in the following ways:

• Routing optimization: automatically routing your connection to the strongest available partner network in real time
• Congestion management: during periods of severe network congestion, connections may be deprioritized based on plan type and current usage levels
• Throttling for policy compliance: where required by partner carrier agreements, certain traffic types may be subject to speed restrictions

8. Intellectual Property

All content, software, trademarks, and materials provided through our Services are owned by Aura Wireless or our licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

9. Privacy

Your use of our Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our collection and use of your information as described in the Privacy Policy.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AURA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. WIRELESS SERVICES ARE INHERENTLY SUBJECT TO FACTORS OUTSIDE OUR CONTROL INCLUDING NETWORK AVAILABILITY, WEATHER, AND THIRD-PARTY INFRASTRUCTURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AURA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Aura and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state of Delaware, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services that cannot be resolved informally shall be resolved by binding individual arbitration under the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit or class-wide arbitration. To initiate arbitration, send written notice to our email address below.

You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing us with the subject line "Arbitration Opt-Out."

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email or website notice. Your continued use of the Services after the effective date constitutes acceptance. If you do not agree to the updated Terms, you must cancel before the effective date.

15. Termination

We may suspend or terminate your account and access to the Services at any time for violation of these Terms, non-payment, fraudulent activity, or for any reason with 30 days' written notice. You may cancel your account at any time as described in Section 5.
